TERMS AND CONDITIONS

Please read our terms and conditions carefully before contracting any service with us!

1.CONTRACT WITH REFUGIOS SALKANTAY

The following terms and conditions (the "Terms") constitute the entire understanding and agreement between REFUGIOS SALKANTAY ("we" or "our") and the client (the "Client" or "you") regarding all and each of the reservations, trips, or transactions made with REFUGIOS SALKANTAY.

2. RESERVATIONS

To book a space on any trip, each Client must provide:

  • Full personal information of all travelers

  • Full name as in your passport

  • Passport number, nationality, age, gender

  • Confirm if you are an Adult or Student. Students apply only to those under 24 years old "with International Student Visa Card"

  • Confirm trip and departure date.

  • Inform us about food comments "vegetarian, allergies, etc."

  • A deposit of USD $ 100 per person for independent service (credit card payment, online payment). + Transfer commission according to payment method.

  • A deposit of USD $ 200 for full service (credit card payment, online payment). + Transfer commission according to payment method.

The Travel Cost Balance (the "Balance") is due 01 day before departure in our office in Lima or Cusco.

3. PAYMENTS

The payment of the Balance can be made by:

Credit card (Visa, American Express), personal/cashier's check, money order.

The Balance payment presented with less than 05 days before the trip departure must be made by credit card or other form of payment specifically approved by REFUGIO SALKANTAY. If the Balance payment is not paid by its due date, REFUGIOS SALKANTAY reserves the right to treat the reservation as canceled. No one will be allowed to leave on a trip unless REFUGIOS SALKANTAY has received all necessary payments and documents.

4. SINGLE SUPPLEMENT

All accommodations (hotels, boats, tents, etc...) are based on double occupancy. We will try to find roommates for solo travelers who wish to share accommodation. If this is not feasible or if you prefer individual accommodation, you will be charged the indicated Single Supplement fee for the itinerary.

5. CANCELLATION BY THE CLIENT

If you must cancel, all reservation deposits will be returned less a cancellation fee. Cancellations must be in writing. If made 91 or more days before departure, the cancellation fee is $50 per person, and any cancellation fee, surcharge or non-refundable deposit charged to REFGIOS SALKANTAY by individual hotels, airlines, or other third parties will be charged to your "travel cost" file. If made between 31 and 60 days before departure, the charge is 50% of the Travel Cost, and if made 30 days or less before departure, the cancellation charge is 100% of the Travel Cost. No partial refunds will be given for unused hotel rooms, meals, sightseeing trips, or trekking arrangements for any reason. The Travel Cost is quoted as a package, and no credits are given for unused services. Some trips, such as the Inka Trail to Machu Picchu, have a different cancellation policy.

6. PRICES, SURCHARGES, AND VALIDITY

As we publish our prices in advance, REFUGIOS SALKANTAY may occasionally face significant increases in costs due to factors beyond our control. Consequently, we reserve the right to charge the Client a surcharge due to unfavorable exchange rates, increases in airfares or other transportation costs, taxes, personnel payment, or if government action forced us to do so. Surcharges will be calculated according to the total additional cost, compared to the original costs and exchange rates. Likewise, if our costs decrease, we will pass on the savings to the Client.

7. AIRLINES

REFUGIOS SALKANTAY is not responsible for any act or omission of any airline. We may use airlines different from those mentioned in our advertisements, and REFUGIOS SALKANTAY cannot guarantee the type of aircraft any airline will use. Furthermore, REFUGIOS SALKANTAY is not responsible for losses due to canceled flights, or changes in flight itineraries or seat assignments. The Client may not cancel the contract without penalty for changing the airline, aircraft type, route, or destination. The liability of the airlines is limited to the transportation of passengers and baggage in accordance with the terms and conditions of the airline's service.

8. DELAYS

Any costs, whether direct or incidental, incurred by the Client as a result of delays caused by bad weather, trail conditions, river levels, road conditions, transportation delays, illness, government intervention, or other contingencies that are beyond the control of REFUGIOS SALKANTAY will be non-refundable.

9. CHANGES BY REFUGIOS SALKANTAY

Reasonable changes to the itinerary may be made when REFUGIOS SALKANTAY considers it advisable for the comfort and well-being of the Clients due to unforeseen circumstances or circumstances beyond the control of REFUGIOS SALKANTA. If such a change is made before the deposit of USD $100 or $200 depending on the type of service reserved is paid, the Client will be informed about the change at the time of booking. If the change is made subsequently, REFUGIOS SALKANTAY will inform the Client as soon as reasonably possible. Cancellations made by the Client as a result of such a change will be subject to the provisions of the preceding Paragraph 5. REFUGIOS SALKANTAY will not be responsible for any damages arising out of or related to such a change, and the Client waives the right to make a claim for such damages against REFUGIOS SALKANTAY.

10. MODIFICATIONS BY THE CLIENT

Any changes made by the Client between 60 and 30 days before departure will have an administrative fee of $30 per change. Any changes made between 29 and 15 days will have an administrative fee of $50 per change. The Client may not make changes within 14 days of departure. This includes, among others, the booking of accommodation, transfers, or additional excursions. REFUGIOS SALKANTAY is not responsible for any additional expenses incurred by the Client as a result of such changes, including, among others, the non-refundable "Advance Purchase" of REFUGIOS SALKANTAY.

11. TOUR AUTHORITY

The Client must comply at all times with the laws and respect the social norms of the country being visited, as well as all government regulations related to customs, medications, and currency. At all times, the decision of the leader or representative of the REFUGIOS SALKANTAY tour is final on all matters that may threaten the safety or interfere with the well-being of the group or individual Clients. If the Client fails to comply with this section, or if the Client interferes with the well-being of the group or individual Clients, the leader or representative of the REFUGIOS SALKANTAY tour may order the Client to leave the tour without any right to refund.

12. PHYSICAL CONDITION AND MEDICAL HEALTH

It is vital that Clients with medical problems inform us at the time of registration. The trip leader has the right to disqualify any person at any time during the trip if he/she believes that the continued participation of the Client will endanger the health or well-being of the involved Client or the group. Refunds are not given under such circumstances. In the event that a Client is injured or becomes ill, REFUGIOS SALKANTAY will attempt to secure the best possible medical care available. However, REFUGIOS SALKANTAY assumes no responsibility for or with respect to the provision of medical care or its cost.

13. LUGGAGE

REFUGIOS SALKANTAY assumes no responsibility for the loss or damage of luggage in transit to and from a REFUGIOS SALKANTAY trip or during a REFUGIOS SALKANTAY trip.

14. TRAVEL INSURANCE

REFUGIOS SALKANTAY strongly recommends that the Client obtain personal travel insurance, including baggage and cancellation insurance.

Travel insurance is a cost-effective way to protect yourself and your equipment in case of problems due to: canceled trips, delays, medical issues, loss or damage of baggage.

Travel insurance can be purchased through traditional insurance companies or online insurers (such as www.travelguard.com).

15. TRAVEL DOCUMENTS

The Client must obtain and be in possession of a valid passport (THE PASSPORT MUST BE VALID FOR AT LEAST 185 DAYS FROM THE DEPARTURE DATE), all visas, permits and certificates, and vaccination certificates, required for the entire itinerary. The Client accepts responsibility for obtaining these documents and any other necessary documents. The information or advice provided by REFUGIOS SALKANTAY regarding visas, vaccinations, climate, clothing, luggage, special equipment, etc., is provided in good faith but without liability on the part of REFUGIOS SALKANTAY and the Client expressly waives any claim of liability against REFUGIOS SALKANTAY for damages arising from such information or advice.

16. CLAIMS AND COMPLAINTS

If a Client has a claim or complaint against REFUGIOS SALKANTAY, the Client must first inform REFUGIOS SALKANTAY of the claim or complaint in writing within five days after the completion of the trip. Failure to do so waives the Client's right to make any claim or complaint against REFUGIOS SALKANTAY.

17. BINDING ARBITRATION

I agree that any dispute related or referred to in this contract, the catalog, the website or any other literature or material related to my REFUGIOS SALKANTAY trip, or the trip itself, will be resolved exclusively by Peruvian binding arbitration.

18. LIMITATION OF REMEDIES

The Client agrees that the sole remedy for any breach by REFUGIOS SALKANTAY arising out of the Terms shall be the refund of the paid trip cost. To the maximum extent permitted by applicable law, REFUGIOS SALKANTAY shall not be liable for any indirect, special, incidental or consequential damages of any kind (including personal injury), regardless of the form of action, whether in contract, tort (including negligence), or otherwise, even if REFUGIOS SALKANTAY has been advised of the possibility of such damages, and the Client expressly waives any right it may have to recover such damages.

19. DIVISIBILITY

I understand and agree that in the event that one or more provisions of the Terms are deemed invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect any other provision of these Terms, and the Terms shall be interpreted as if such invalid or unenforceable provision had never been contained herein.

20. ENTIRE AGREEMENT.

The Terms constitute the entire understanding between the Client and REFUGIO SALKANTAY in relation to the subject matter of the Terms and supersedes and replaces all prior negotiations, statements and representations with respect to the subject matter of the Terms, except as expressly contained in the Terms.

21. AMENDMENT.

The Terms may not be amended, altered or modified except by a written amendment executed by the Client and REFUGIOS SALKANTAY.

22. CONSTRUCTION.

It is the intention of the Client and REFUGIOS SALKANTAY that no part of the Terms shall be construed against either party due to the identity of the drafter.

23. MEDICAL INSURANCE

Every Client must be covered by personal medical insurance related to the trip. The insurance must cover personal accidents, medical expenses, air ambulance, loss of effects, repatriation expenses and all other expenses that may arise from loss, damage or injury suffered by the Client. The Client agrees to obtain and/or verify that they have sufficient personal medical insurance coverage related to the trip for the journey. Baggage and cancellation insurance is also highly recommended.

I agree to obtain and/or verify that I have the aforementioned personal medical insurance related to the trip that meets the minimum requirements of REFUGIOS SALKANTAY and to provide proof of such insurance to REFUGIOS SALKANTAY.

24. RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS

I, the Client, acknowledge that I have voluntarily requested to participate in the designated trip in this application and have read the trip description as it appears in the itinerary. I am voluntarily participating in this trip with knowledge of the risks involved.

25. RISK ASSUMPTION

REFUGIOS SALKANTAY does not own or operate any entity that provides goods or services for your trip, including, among others, hotels or other lodging facilities, airlines, boats, buses, vans or other transportation companies, local land operators, optional excursion providers, or food or entertainment service providers. REFUGIOS SALKANTAY hereby notifies that it acts independently and is not responsible for the owners, contractors and providers who provide transportation and/or all other related travel services and assumes no responsibility for expenses, injuries, losses, or damages to persons or property resulting from: fortuitous cases, detentions, annoyances, delays, quarantines, strikes, thefts, force majeure (an event or effect that cannot reasonably be anticipated or controlled), The Client voluntarily participates in the trip with knowledge that traveling to foreign countries and/or remote areas visited by this trip involves numerous risks and dangers that the Client accepts, including, among others: forces of nature; civil unrest; terrorism; the condition of roads, trails, hotels, vehicles, boats, or other means of transportation that are not operated or maintained to common U.S. standards; high altitude; accident or illness without access to quick evacuation or availability of medical supplies; the adequacy of medical care once provided; physical exertion for which the Client is not prepared; consumption of alcoholic beverages; or negligence (but not intentional or fraudulent conduct) by REFUGIOS SALKANTAY or those entities with whom REFUGIOS SALKANTAY contracts to provide services to the Client. The Client acknowledges that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement and are a reason for the Client's voluntary participation.

I hereby acknowledge the foregoing and am responsible for my own well-being, and accept each and every risk of delay, unforeseen events, illness, injury, emotional trauma or death.

26. RELEASE

I acknowledge that the cost of all REFUGIOS SALKANTAY trips has been based on Clients executing this Release of Liability and Assumption of All Risks. Therefore, as lawful consideration for being permitted to participate in such adventure travel activities, I hereby RELEASE AND DISCHARGE FOREVER REFUGIOS SALKANTAY AND ANY LIABILITY ARISING FROM MY PARTICIPATION IN THE TRIP. I agree that this release shall be legally binding upon me, all minors traveling with me, all members of my family, my heirs, and their heirs, successors, assigns, and legal representatives, it being my intention to fully assume all risks associated with travel and to release REFUGIOS SALKANTAY from any and all liability to the maximum extent permitted by law.

PARENT OR GUARDIAN OF A MINOR: I, as parent or guardian of the minor named below, give my permission for my child or ward to participate in the trip and further agree, personally and on behalf of my child or ward, to these Terms.
